Terms and Conditions — Solaia

Last updated: 22 October 2026

These Terms and Conditions (“Terms”) govern your access to and use of the Solaia website and your purchase and use of any Solaia product, including Sun Sous sunscreen (“Products”). By browsing this site, placing an order, or using a Product, you agree to these Terms. If you do not agree, please do not use the site or the Products.

Solaia (“we”, “us”, “our”) is an unregistered sole proprietorship trading in South Africa. Our contact details appear at the end of these Terms.

1. Who may use this site

You must be at least 18 years old, and legally capable of entering into a binding agreement, to place an order. If you order on behalf of another person, you confirm you are authorised to do so and that they accept these Terms.

2. About Sun Sous and “lab-credited” claims

Sun Sous is a cosmetic sunscreen product. Where we describe it as “lab-credited”, “lab-tested” or similar, we mean that the product has been tested by an independent laboratory and that the stated Sun Protection Factor (SPF) and, where applicable, broad-spectrum (UVA/UVB) performance reflect the results of that testing as at the date stated on the packaging or product page.

  • Testing results apply to the specific formulation and batch tested. We do not warrant that any individual bottle will perform identically in every real-world condition.
  • SPF is a laboratory measure of protection against sunburn under standardised test conditions. It is not a measure of how long you can safely stay in the sun, and it does not provide 100% protection.
  • No sunscreen protects completely. Sun exposure remains a risk even when sunscreen is used correctly.
  • We may update formulations, packaging, labelling or test data from time to time. Where a material change occurs, we will update the relevant product page.

3. Cosmetic, not medical, product

Sun Sous is a cosmetic product intended for topical use on healthy, intact skin. It is not a medicine, drug, therapeutic device or treatment, and it is not intended to diagnose, treat, cure or prevent any disease or medical condition, including skin cancer, photoaging, melasma, eczema, rosacea or any other dermatological condition.

Nothing on this website — including any reference to dermatological testing, dermatologist review, or suitability for sensitive skin — constitutes medical advice, a prescription, a diagnosis, or a clinical recommendation for your individual circumstances. Always read the label and the ingredient list before use.

4. Dermatological use, patch testing and skin reactions

Patch test before first use. Apply a small amount to a discreet area of skin (for example the inner forearm) and wait at least 24 to 48 hours before applying the product more widely. Do not use the product if you observe redness, itching, burning, swelling, blistering or any other reaction.

Stop use immediately if a reaction occurs. Discontinue use at once if you experience irritation, redness, rash, itching, burning, stinging, swelling, hives, blistering, pigmentation changes, acne-like breakouts, or any other adverse skin reaction, and seek advice from a qualified healthcare professional if symptoms persist, worsen or are severe.

Allergies and sensitivities. Sunscreen ingredients — including chemical UV filters, mineral filters, preservatives, fragrances, emulsifiers, antioxidants and botanical extracts — can cause allergic contact dermatitis or photoallergic reactions in susceptible individuals. Review the full ingredient list before purchase if you have known allergies or sensitivities.

Do not use on damaged skin. Do not apply to broken, cracked, sunburnt, irritated, infected, post-procedure or recently shaved or waxed skin, or to any area affected by an active skin condition, unless a qualified healthcare professional has advised otherwise.

Consult a professional first if you: are pregnant or breastfeeding; are using prescription topical products such as retinoids, acids, or acne treatments; have had recent chemical peels, laser, microneedling or other dermatological procedures; have a diagnosed skin condition; are taking photosensitising medication; or are applying the product to an infant or child. In these cases, obtain advice from a doctor, dermatologist or pharmacist before use.

Children. Sun Sous is not intended for use on infants. For children, use only as directed by a parent or guardian and in line with the product label and paediatric or dermatological advice.

5. Correct use and limitations

  • Apply generously and evenly to all exposed skin approximately 15 to 20 minutes before sun exposure, and reapply at least every two hours, and immediately after swimming, towelling, sweating heavily or prolonged activity.
  • Use in combination with other sun-protective measures: shade, protective clothing, hats, sunglasses, and avoiding peak-intensity sun (generally 10:00 to 16:00).
  • Do not apply to the eyes or eyelids. Avoid contact with mucous membranes. Rinse with clean water if contact occurs.
  • Do not inhale, ingest or apply internally. Keep out of reach of children and pets.
  • Do not use past the expiry or period-after-opening date shown on the packaging, and do not use if the texture, colour or odour has changed.
  • Store below 30°C, out of direct sunlight, and away from heat sources. Do not leave in a hot car.
  • Do not dilute, mix with other products, or decant into unlabelled containers.

6. Orders, pricing and payment

  • All prices are shown in South African Rand (ZAR) unless stated otherwise, and include VAT where applicable.
  • We may change prices, product availability and specifications at any time before you place an order. The price confirmed at checkout applies to that order.
  • We may decline or cancel an order where there is an obvious pricing or listing error, suspected fraud, stock unavailability, or a delivery address we cannot service. Where payment has already been taken, we will refund it in full.
  • Payment must be made in full before dispatch, using the payment methods offered at checkout.

7. Delivery

Delivery timelines are estimates only and are not guaranteed. Risk in the Products passes to you on delivery to the address you supplied. Please inspect your order on receipt and report shortages, damage or incorrect items within 7 days.

8. Returns, refunds and your consumer rights

Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002, where those apply.

  • Sealed, unopened products: you may return them within 14 days of delivery for a refund, provided they are unused, undamaged and in original packaging. Return shipping may be for your account unless the product was defective or incorrect.
  • Opened or used products: for health and hygiene reasons, we cannot accept returns of opened cosmetic products unless the product is defective, not as described, or caused an adverse reaction.
  • Adverse reactions: if you believe a Product caused a reaction, stop using it, keep the product and packaging, and contact us. We may ask for photographs, batch details and a description of your experience. We will assess the matter in good faith and comply with any applicable reporting obligations to the relevant authorities.
  • Defective or incorrect items: contact us within 7 days of delivery and we will replace or refund, including reasonable return shipping.

9. Warranty and limitation of liability

To the maximum extent permitted by law, the Products are supplied “as is” and we make no warranty beyond those that cannot lawfully be excluded, including that the Products are of good quality, reasonably suitable for their general purpose as a cosmetic sunscreen, and match their description.

We do not warrant any particular outcome, level of protection, cosmetic result, or freedom from skin reaction for any individual user.

To the maximum extent permitted by law, and subject to the paragraph below, Solaia is not liable for any indirect, incidental, special or consequential loss, or for loss of profits, data or goodwill, arising from your use of the site or the Products. Our total aggregate liability for any claim relating to a Product is limited to the amount you paid for that Product.

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; liability under the Consumer Protection Act or any other law that cannot be excluded; or any other liability that may not lawfully be limited.

10. Intellectual property

All content on this site — including the Solaia and Sun Sous names, logos, product photography, copy, formulations descriptions, packaging design and test documentation — is owned by or licensed to us and is protected by copyright and trademark law. You may not copy, reproduce, modify, distribute or use it commercially without our prior written permission.

11. Reviews, submissions and user content

If you submit a review, photograph, comment or other content, you confirm it is accurate, your own, and does not infringe anyone’s rights or contain unlawful, defamatory or misleading material. You grant us a non-exclusive, royalty-free licence to display and use that content on our site and marketing channels. We may remove content at our discretion. We do not edit reviews to change their meaning, and we do not suppress genuine negative reviews.

12. Privacy and data

We collect and process personal information (such as your name, contact details, delivery address and order history) to process orders, deliver Products, handle returns and complaints, and meet legal obligations. We handle personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA). We do not sell your personal information. Our full privacy notice is available on this site.

13. Acceptable use of this site

You agree not to misuse this site, including by attempting unauthorised access, scraping or harvesting data, introducing malicious code, interfering with its operation, or using it for unlawful, misleading or fraudulent purposes.

14. Third-party links and services

This site may link to third-party sites or use third-party services (for example payment processors and couriers). We are not responsible for their content, terms or practices. Your use of those services is governed by their own terms.

15. Changes to these Terms

We may update these Terms from time to time. The version in force at the time you place an order governs that order. Continued use of the site after an update constitutes acceptance of the revised Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the South African courts. Before litigating, we ask that you contact us directly so we can try to resolve the matter informally. Where applicable, you may also refer a consumer complaint to the National Consumer Commission or the Consumer Goods and Services Ombud.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a right is not a waiver of it. These Terms, together with our privacy notice and any order confirmation, constitute the entire agreement between us regarding the Products.

Important note on the “lab-credited” wording: because Solaia is not yet a registered business, and because sunscreen claims are regulated in South Africa (cosmetic labelling and SPF claims fall under the Department of Health and the SAHPRA framework, and advertising is overseen by the Advertising Regulatory Board), I’d strongly suggest you have a consumer-law or regulatory attorney review this before publishing. Two things worth fixing before launch: (1) register the business and get a trading name you can defend in the IP clause, and (2) make sure every SPF and “lab-tested” claim on the site is backed by a test report you can produce on request — an unsubstantiated claim is the single biggest legal exposure in sunscreen marketing. This is general information, not legal advice.
